TERMS OF SERVICE
Last updated: October 8, 2026
Welcome to The Outlaw Herbalist™.
The Outlaw Herbalist™ is a brand operated by Transcendent Roots LLC (“The Outlaw Herbalist,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, content, educational materials, events, services, and related offerings (collectively, the “Services”).
Our online store is powered by Shopify.
By accessing our website, purchasing a product, booking a service, participating in an event, or otherwise using our Services, you agree to these Terms and our applicable policies, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
If you do not agree to these Terms, please do not use the Services.
1. Eligibility
By using the Services, you represent that you are at least the age of majority in your jurisdiction or otherwise legally permitted to enter into a binding agreement.
You may not use our Services or products for unlawful purposes or in violation of applicable laws or regulations.
2. Herbal Education Disclaimer
The Outlaw Herbalist™ provides information about herbs, botanicals, teas, traditional herbal practices, folklore, historical uses, energetics, and related subjects for general educational and informational purposes only.
Information provided through our website, product descriptions, social media, printed materials, events, consultations, workshops, or other communications is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The Outlaw Herbalist™ and Transcendent Roots LLC do not represent themselves through these Services as a physician, pharmacist, registered dietitian, or other licensed healthcare provider.
Purchasing a product, attending an event, communicating with us, or receiving herbal education does not create a physician-patient or other licensed healthcare-provider relationship.
Traditional use of an herb does not establish that it is appropriate or safe for every individual.
3. Individual Health Responsibility
Herbs and botanical products can affect individuals differently.
Some herbs may cause allergic reactions, sensitivities, side effects, or interactions with medications, supplements, medical conditions, pregnancy, breastfeeding, surgical procedures, or other circumstances.
You are responsible for determining whether a product is appropriate for your individual circumstances.
If you are pregnant or breastfeeding, have a medical condition, take prescription or over-the-counter medications, have known allergies or sensitivities, are preparing for surgery, or have questions regarding the safety of a botanical product for you, consult an appropriately qualified healthcare professional before use.
Never delay or discontinue appropriate medical care because of information provided by The Outlaw Herbalist™.
In the event of a medical emergency, seek appropriate emergency medical assistance.
4. Product Information
We make reasonable efforts to provide accurate descriptions, ingredient information, photographs, weights, and other information regarding our products.
However, botanical products are agricultural materials and naturally vary.
Differences in color, aroma, flavor, texture, cut, density, appearance, moisture content, harvest, origin, or other natural characteristics may occur from batch to batch and do not necessarily indicate that a product is defective.
Product photographs are illustrative. Screen settings, lighting, natural botanical variation, packaging updates, and seasonal availability may result in differences between photographs and the product received.
We reserve the right to modify packaging, sourcing, formulations, product availability, and product descriptions when reasonably necessary.
5. Ingredients, Allergies & Sensitivities
Customers are responsible for reviewing product descriptions and ingredient information before purchasing or using a product.
Although we take reasonable precautions when handling and packaging products, products may be prepared, stored, or packaged in environments where other botanicals, foods, or potential allergens are also present.
Individuals with severe allergies or sensitivities should contact us with questions before purchasing.
We cannot guarantee that any product or preparation environment is completely free from trace exposure to allergens unless we expressly state otherwise.
6. Proper Use & Storage
Customers are responsible for following any preparation, handling, storage, serving, or usage information supplied with a product.
Botanical products should be stored appropriately and kept away from children and animals unless a product is expressly identified for their use.
The Outlaw Herbalist™ is not responsible for harm resulting from misuse, excessive consumption, improper preparation, improper storage, alteration, combination with other substances, use contrary to provided instructions, or use for purposes for which a product was not offered, to the extent permitted by law.
7. Children & Products
Unless expressly identified otherwise, our herbal products and educational information are intended for adult purchasers.
Parents and guardians are responsible for determining whether any product is appropriate for a child and should consult an appropriately qualified healthcare professional when appropriate.
Children should not independently prepare or consume botanical products without appropriate adult supervision.
8. Orders
We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including because of:
- Product availability or inventory errors
- Pricing or listing errors
- Suspected fraud or unauthorized transactions
- Shipping or geographic restrictions
- Regulatory or licensing limitations
- Suspected resale or misuse
- Circumstances that prevent us from lawfully or reasonably fulfilling an order
If we cancel an order after payment has been collected, the applicable amount will be refunded.
9. Pricing & Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Prices, product availability, promotions, and discounts may change without notice.
We reserve the right to correct typographical, pricing, inventory, or product-description errors. If an error affects an order already placed, we may contact you regarding available options or cancel and refund the affected item.
Payment processing may be performed by Shopify and other third-party payment providers. Their terms and privacy practices may also apply.
10. Geographic Sales Restrictions
Certain products offered through The Herb House are currently offered for sale and shipment within California only, consistent with our current business operations and applicable licensing requirements.
Customers purchasing California-restricted products must provide an eligible California delivery address.
Other eligible products offered through our shop may be available for nationwide U.S. shipping.
We reserve the right to restrict the sale or shipment of any product based on destination, licensing, regulatory requirements, carrier limitations, or other legal or operational considerations.
International shipping is not currently offered.
Please review our Shipping Policy for additional information.
11. Baked Goods & Local Pickup
Baked goods are offered separately through limited releases, pre-orders, pop-ups, or scheduled local pickup events.
Baked goods are not shipped.
Specific ordering windows, availability, pickup dates, times, and locations will be provided for each release.
Customers are responsible for reviewing and following the pickup instructions associated with their order.
Additional product-specific disclosures, ingredient statements, allergen information, and legally required labeling may accompany baked goods.
12. Shipping
Shipping availability depends on the product purchased and destination.
Customers are responsible for providing complete and accurate shipping information.
Carrier delays, weather events, service interruptions, and other circumstances outside our reasonable control may affect delivery.
Our complete shipping terms are provided in our Shipping Policy, which is incorporated into these Terms by reference.
13. Returns & Refunds
Due to the consumable and sensitive nature of herbs, teas, botanical blends, food products, and similar goods, applicable consumable products are final sale, subject to applicable law.
Damaged, defective, or incorrectly fulfilled orders will be handled according to our Return & Refund Policy.
Please review the Return & Refund Policy before completing your purchase.
14. Educational Services, Events & Herbal Consultations
The Outlaw Herbalist™ may provide educational conversations, herbal consultations, workshops, pop-ups, demonstrations, classes, informational materials, or other plant-centered experiences.
These offerings are educational in nature.
They do not constitute diagnosis, medical treatment, psychotherapy, nutritional therapy, veterinary care, or another licensed healthcare service unless expressly stated otherwise.
Any decision to purchase, prepare, consume, or otherwise use an herb or botanical product remains the customer's responsibility.

Such material is provided for educational, historical, cultural, creative, or spiritual exploration.
Statements regarding energetic, spiritual, symbolic, ritual, or folkloric properties should not be interpreted as scientific or medical claims.

Purchasing a digital product does not transfer ownership of the underlying intellectual property.
Digital materials may not be reproduced, redistributed, uploaded, resold, shared commercially, or presented as the purchaser's own work without written authorization.
18. Reviews, Comments & User Content
If you submit reviews, photographs, comments, testimonials, suggestions, or other content through our Services, you represent that you have the right to submit that material.
